The dispute in the present petition pertains to mutation with respect to an agricultural land, which was the subject matter of Second Appeal Nos.195/2022 and 171/2022. The title of the petitioner is confirmed by this Court vide judgment dated 17/10/2024 passed in Second Appeal Nos.195/2022 and 171/2022, inasmuch as the sale of the suit property is in favour of the petitioner in Court auction is held to prevail over the sale-deed executed in favour of respondent Nos.1 to 4. 03.

In view of above, the mutation entry with respect to the said property will have to be recorded in the name of the petitioner in accordance with the judgment dated 17/10/2024 delivered in Second Appeal Nos.195/2022 and 171/2022. It will be pertinent to state that applications for review being MCA (Review) Nos.145/2025 and 146 are also rejected by this Court vide order dated 26/09/2025. 04.

In view of the above, the writ petition is allowed directing the respondents-authorities to record mutation with respect to the suit property in favour of the petitioner in view of the decision of this Court

It is clarified that in the event, the aforesaid judgment and order dated 17/10/2024 passed in Second Appeal Nos.195/2022 and 171/2022 and dated 26/09/2025 passed in MCA (Review) Nos.145/2525 and 146/2025 are reversed or modified by the Hon'ble Supreme Court the mutation entry shall obviously be altered accordingly. The writ petition is disposed of in the aforesaid terms. No costs. JUDGE *sandesh
