Learned Counsel appearing for the non-applicant no.2 would submit that the efforts of settlement have been made however it has not been worked out. It is submitted that the matter was already referred for mediation, but it remains unsuccessful. In the changing scenario, the wife do not wish to settle the dispute and therefore, she prayed to dispose of this application. 3.

We are in receipt of report of the Mediator dated 09.11.2023 informing that the matter could not be settled despite several meetings. We cannot force a lady to settle the dispute though we are desire for settlement. Since the wife is not willing to settle the dispute, the criminal application stands disposed of.
