Apprehending arrest in connection with Crime No.447 of 2017 registered by the non-applicant against the applicant and her son for the offence punishable under Sections 306, 498-A of the Indian Penal Code, the applicant has sought pre-arrest bail.

The crime is registered on the complaint by mother of the deceased that because of the harassment by the accused, the deceased has committed suicide within one year of marriage.

The learned advocate for the applicant has submitted that the victim had attempted to commit suicide on 16th April, 2017, she survived and was hospitalized and then the she died on 27th May, 2017. It is submitted that there is delay of about 80 days in lodging the F.I.R. It is pointed out that co-accused Abdul Sharique (husband of the deceased) is released on bail as per the order passed by the Sessions Court.

2 aba570.17 The applicant, woman aged about 50 years, claims to be housewife and has submitted that she is not involved in any other crime /offence and as the non-applicant has not been able to point out that custody of the applicant is required for further investigation, following order is passed : In the event of arrest in connection with Crime No.447 of 2017 registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Twenty Thousand and furnishing one solvent surety in the like amount.
