NAGPUR BENCH, NAGPUR Writ Petition No.5473 of 2016 (Smt. Manisha w/o Ashok Belani v. State of Maharashtra, through its Deputy Registrar, Cooperative Societies, Nagpur, and others) Office Notes, Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders and Registrar's order Shri S.K. Tambde, Advocate for Petitioner.

Shri N.S. Rao, Assistant Government Pleader for Respondent No.2.

Coram : R.K. Deshpande, J.

Date : 15 th October, 2016 Shri Tambde, the learned counsel for the petitioner, is unable to point out as to how the provisions of the Limitation Act, 1963 apply to the proceedings under Section 101 of the Maharashtra Co-operative Societies Act, 1960. It is absolutely not in dispute that the period of limitation prescribed under Section 92(b) of the Maharashtra Co-operative Societies Act does not apply to the proceedings under Section 101 of the said Act. In view of this, nothing survives in this petition. The petition is dismissed.

On merits of the matter, it shall be open for the petitioner
