Apprehending arrest in connection with Crime No.1119/2017 registered by the non-applicant for the offence punishable under Section 65(e) of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, the applicant seeks pre-arrest bail. According to the investigating agency, it received information that liquor is stored in the house of the applicant for sale, a raid was conducted and liquor worth Rs.90,000/- is seized from the house of the applicant.

The applicant contends that he is falsely implicated. The applicant, aged about 42 years, claims to be a labourer and has stated that he is living in the house with old parents, wife and minor children. It is submitted that the applicant is not involved in any other crime / offence.

In the facts of the case, following order is passed:

In the event of arrest in connection with Crime No.1119/2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.25,000/- (Rs. Twenty Five Thousand) and furnishing one solvent surety in the like amount. The application is allowed in the above terms. JUDGE Tambaskar.
