At the instance of report lodged by the informant-lady,the crime was registered for the offence punishable under Section 420 of the Indian Penal Code. It is the informant's grievance that the applicant assured her for guiding her to start business and under such pretext, took Rs.6 lakhs from her. The accused also gave a cheque towards repayment, however, it has been dishonored, therefore, the report.

In order to show bona fides, the applicant has deposited Rs.6 lakhs in this Court. Without prejudice to the rights of the applicant to put up the defence in criminal case, the applicant agrees that the amount deposited in this Court, be returned to the informantlady. The said statement is made by the learned Counsel for the applicant, upon such instructions. Having regard to the said fact, there is no necessity to

2 13 aba 792 have custodial interrogation. Hence, the following order :

(a) Criminal Application stands allowed and disposed of.

(b) Ad-interim order dated 24.11.2021 is hereby made absolute upon same terms and conditions. (c) Henceforth, the applicant shall continue to attend concerned Police Station as and when called.

(d) The applicants/accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.

The informant-lady namely Annapurna Ashok Wankhade is entitled to withdraw the amount of Rs.6 lakhs deposited in this Court, along with interest, if any.

The State is directed to communicate this order to the informant-lady.
