Heard Shri Bhattad, learned counsel for the petitioner.

The records of present writ petition are being reconstructed. However, the counsel for the petitioner has expressed some difficulty in assisting the Registry in the matter.

A pursis has been filed on 27.04.2010 informing the Court that action impugned was cancelled and was not continued subsequently. Shri Bhattad, learned counsel, even today submits that the challenge was rendered infructuous.

We accordingly accept the statement and Writ Petition No. 5804 of 2005 is disposed of as infructuous. However, as the records are not traceable, it is made clear that this order shall not come in the way of any of the parties and contentions of the parties including the respondents are kept open.
