Ms. T.H. Khan, learned AGP appearing for the respondents has pointed out averment made by the petitioner in para no. 9 that the petitioner has filed appeal to challenge the order passed by the Collector on 03/01/2018, which is challenged in this petition. It is submitted that this is nothing but abuse of process of law.

In view of the objection raised on behalf of the respondents, the learned advocate for the petitioner, on instructions, seeks permission to withdraw the writ petition with liberty to pursue alternate remedy.

The petition is disposed as withdrawn with liberty as prayed for. In the circumstances, the parties to bear their own costs.
