Heard Ms B.P.Maldhure, learned Assistant Government Pleader for the applicant and Mr. V.N. Patre, learned Advocate for the non-applicant.

Though some necessary details are lacking in the application, considering the facts of the case, delay in filing the first appeal is condoned.

The appellant shall pay costs of Rs.One Thousand to the learned Advocate for the respondent and produce receipt on record till 5th May, 2015, failing which the appeal shall stand dismissed without reference to this Court. The application is allowed and disposed of in the above terms.

The appellant shall file private paper book within six months, failing which the appeal shall stand dismissed without further reference to this Court.

CIVIL APPLICATION NO. 66/2013.

Until further orders, there shall be stay to the execution of the impugned order on the condition that the appellant shall deposit the entire amount as per the impugned order with Registry of this Court till 5th May, 2015, failing which the interim order shall stand vacated without further reference to this Court.

List the Civil Application for further consideration on 12th June, 2015.
