Thakkar, counsel for the petitioner. CORAM : DR. MANJULA CHELLUR, C.J. AND SMT. VASANTI A NAIK, J.
DATE : OCTOBER 19 , 2016.
P.C.:
On perusal of the proceedings, it seems that the challenge is with regard to the course of action initiated under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and in the light of pendency of proceedings before the Debts Recovery Tribunal in respect of the very loan account of the writ petitioner, we are of the opinion that the grievance raised in the writ petition has to be addressed before the Debts Recovery Tribunal and not under Article 226 of the Constitution of India.
With these observations, the writ petition is disposed of.
CHIEF JUSTICE SMT.VASANTI A NAIK, J.
