The petitioner is lodged in Open Prison, Morshi. As per the judgment delivered by the Larger Bench of this Court, a prisoner who is lodged in Open Prison, can also be considered for his release on furlough on the personal bond and cash surety.

The matter is, therefore, remitted back to the respondent-authorities for considering as to whether the petitioner can be released on personal bond and cash surety. The matter on remand be decided within a period of 15 days.

The fees of the learned counsel appointed for the petitioner are quantified at Rs.1500/-.
