DATED : 30-11-2021 The applicant is seeking bail in connection with Crime 505/2021 registered with City Kotwali Police Station, Akola for offeence punishable under Section 7 of the Prevention of Corruption Act.

Mangesh Ingle approached the Anti Corruption Bureau (ACB) alleging that the applicant demanded bribe of Rs.6,000/- (Rupees Six Thousand) to expedite the issuance of Caste Certificate. The ACB led a trap and allegedly apprehended the applicant red handed accepting Rs.5,000/- (Rupees Five Thousand) from the complainant.

Although the charge-sheet is not filed as yet, the case diary is made available for my perusal. Considering that the prosecution contends that the applicant was successfully trapped, and the panch witnesses are Government employees, there is no real possibility of the applicant being in a position to influence the investiga-

2 ba1202.21 tion, assuming that any investigation is left to be done. 4.

I do not see any propriety in continuing the incarceration since releasing the applicant on bail is not likely to adversely affect the investigation and the process of submission of the charge-sheet.

The application is allowed.

The applicant shall be released on bail on executing personal bond of Rs.16,000/- (Rupees Sixteen Thousand) with a solvent surety of like amount. 7.

The applicant shall not make any attempt to tamper with the evidence or to influence witnesses, directly or indirectly.

8.

The applicant shall attend each date of hearing scrupulously.

9.
