In the present petition, following prayers are made: "a) direct the Respondents to regularize the service of the Petitioner driver (blood vans) as permanent employee in public health department;

b) direct the Respondents not to disturb the post/appointment of the Petitioner during pendency of instant petition;

c) direct the Respondents to protect the as pay of the Petitioner as regular employee from completion of 10 years of service; i.e. from years 2020;

d) by ad-interim ex-parte order direct the Respondents not to disturb the service of the Petitioner during pendency of the petition;

2/3 e) grant any other suitable relief to which the Petitioner is entitled in the facts and circumstances of the present case." 3.

Prior to approaching this Court and seeking the present reliefs, the petitioner had submitted representations to respondent Nos. 2 and 3, which remain pending till date.

Considering the prayers of the petitioner and the fact that the representations of the petitioner have not been decided till date by the respondent Nos.2 and 3, we are of the considered view that purpose would be served, if the respondent No.3 is directed to treat the present petition as a representation of the petitioner and to decide the same in accordance with law.

Accordingly, the writ petition is disposed of with direction to the respondent No.3 to treat the present petition as the representation made by the petitioner and decide the same on merit, in accordance with law. 6.

The petitioner relies upon the judgment of the Hon'ble Supreme Court of India in the case of Jaggo ..vs.. Union of India and others reported in 2024 SCC OnLine SC 3826.

The respondent No.3 shall take into consideration the law laid down in this judgment while considering the prayers of the petitioner.

The respondent No.3 shall decide the representation after hearing the petitioner.

The representation shall be decided within six weeks from the date of appearance of the petitioner. 9.

The petitioner shall appear before the respondent No.3 on 02.12.2025 at 11.00 a.m. along with a copy of the petition, the documents annexed thereto, and a copy of this order.

The respondent No.3 shall communicate the decision so taken within two weeks from the date of such decision, to the petitioner.
