The application seeks transfer of HMP No.271/2022 pending before the 4th joint C.J.S.D., Nagpur, to the Court at Warora, District Chandrapur, on the ground that Domestic Violence proceeding instituted by the wife are already pending there. In view of what has been held in D. Raja Rajeswari Vs Satish Kumar (2022) 2 SCC 329, the HMP No.271 of 2022 pending on the file of 4th C.J.S.D., Nagpur is hereby transferred to the Civil Court at Warora. 3.

It is made clear that all the matters which are instituted by the applicant against the respondent shall be listed on the same day in order to avoid any inconvenience to the respondent. 4.

In case there is Video Conferencing facilities available with the Court at Warora, any application filed by the non-applicant for appearing in the proceedings through video conferencing shall be taken into consideration, unless the personal physical presence is desired by the Court.

The applicant shall place a copy of this order before the 4th Joint C.J.S.D., Nagpur on 5-12-2022 to apprise him of the same

2/2 and enable him to transfer the record to the Civil Court at Warora. 6.

The parties shall put an appearance before the C.J.S.D., Warora on 12-12-2022. Application is allowed in the above terms. No costs.
