For the order that is proposed to be passed, it is not necessary to issue notice to the Respondents. 3.
The Petitioner has stated in the petition that though the Petitioner has superannuated from service of the Respondent - Zilla Parishad, Gondia, his pensionary benefits are not being released. The Petitioner has pointed out this fact to the Chief Executive Officer by a communication dated 29 July 2021. Learned Counsel for the Petitioner states that this has not been replied to even though the Petitioner has retired on 31 December 2020.

The Chief Executive Officer will examine the case and direct the concerned Officer to process the Petitioner's file and take necessary steps within a period of six weeks from today. If the Petitioner is not entitled to the pensionary benefits, the Petitioner would be informed by passing a separate order on the same. However, if it is found that the Petitioner's pension has been unduly withheld even after the period of six weeks then the pensionary benefits will carry interest @ 6% per annum. 5.
