Apprehending the arrest at the hands of police in connection with Crime No.424/2024 registered with Police Station Balapur, District - Akola, for the offence punishable under Section 135 of the Electricity Act, 2003, the applicant approached to this Court for grant of pre-arrest bail. 2.

The allegation against the present applicant is that he has committed the theft of electricity worth of Rs.55,452/-. 3.

Learned counsel for the applicant submitted that he has deposited the said amount and also the electric meter was seized, and thereafter, his electricity supply is also restored. 4.

Learned APP strongly opposed the said application but admitted this fact, that he has already deposited the said amount and his electricity supply is also restored. Considering the above, the application deserves to be allowed. Accordingly, I proceed to pass the following order;

32ABA587.2024.odt a] In the event of the arrest, the applicant - Sheikh Akbar Sheikh Bismillah in connection with Crime No.424/2024 registered with Police Station Balapur, District - Akola, for the offence punishable under Section 135 of the Electricity Act, 2003, shall be released on anticipatory bail on executing P.R. bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

b] The applicant shall attend the concerned police station as and when required for the investigation purpose and shall cooperate with the investigating agency.

c] The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case.

The application is disposed of.
