Considering the limited prayer made in the writ petition, same is taken up for final adjudication.
The petitioner is serving as an Assistant Teacher with Zilla Parishad Buldhana and is presently posted at Zilla Parishad Primary School, Boriadgaon, Panchayat Samiti Khamgaon. It is stated that the petitioner delivered a girl child on 23/09/2020 and thereafter proceeded on maternity leave. The petitioner submits that she resides at Buldhana which is at a distance of 75 km from the place where she is posted. Hence on 11/01/2021 and 05/08/2021 she had made a request to the Chief Executive Officer to transfer her at a school near Buldhana so as to facilitate taking care of her child. Since those representations
35-WP-4742-21 2/2 have not been decided, this writ petition has been filed. While issuing notice on 25/11/2021 the respondent was granted liberty to decide the representations in the meanwhile. Today learned counsel for the respondent seeks time to file reply on record. We find that interests of justice would be served by directing the Chief Executive Officer to take a decision on the representations dated 11/01/2021 and 05/08/2021 within a period of fifteen days from the production of this order. The decision taken shall be communicated to the petitioner. Needless to state that such decision shall be taken in accordance with law and after considering the relevant applicable transfer policy.
With aforesaid directions, the writ petition is disposed of with no order as to costs.
