Nobody appears for non-applicant No.1, though duly served with notice.

For the reasons stated in the application, the application is allowed and it is directed that Criminal Application No.206/2015 be restored to the original filed subject to the condition that the applicant shall pay costs of Rs.1,000/- (Rupees One Thousand Only) to be deposited in the account of Bombay High Court Legal Service Sub-Committee, Nagpur within a period of four weeks from the date of the order, failing which, Criminal Application No.206/2015 shall stand dismissed without further reference to the Court.

The application is disposed of accordingly.
