I have heard learned Counsel for the applicant and learned APP for the State to some extent. Perused the investigation papers from which it reveals that the applicant along with the other co-accused by holding weapons in their hands had been to the Mahagaon Ghat for excavation of the sand. At the relevant time, there was a scuffle between the Security Guard and the Security Guard was assaulted. Considering the prima facie case against the present applicant, I have shown my disinclination to grant bail to the present applicant. 3.

In view of that, learned Counsel for the applicant seeks permission to withdraw the application. 4.

Permission is granted.
