This is an application filed for cancellation of bail already granted to the accused. The ground for cancellation is that the accused persons after their released from jail entered the house of the complainant/victim and assaulted on him and also gave threats not enter the witness box. Shri S.V. Sirpurkar, the learned Counsel for the respondents submits that the police after investigation have found that the complaint was false and therefore filed D Summary. The trial is not yet held and is pending since 2014 before the trial Court having Sessions Trial No.5 of 2014. Looking to the lapse of period and in view of the statement made by Shri Sirpukar, the learned Counsel for the respondents, the respondents
would reside at the place other than the place where the victim resides and report the Police Station Pimpalgaon Raja and appear on the dates given by the Sessions Judge for trial. In view of the above, I make the following order :- Order A] Criminal Application (APPLN) No.88 of 2014 is disposed of.
B] The learned trial Judge is directed to commence and complete the trial, in any case, within a period of six months from today.
C] The respondent nos. 2 and 3 shall not reside the vicinity of victim/complainant i.e. Bhalegaon, Tq. Khamgaon, Dist Buldhana and shall reside other than the place where the victim resides.
