Perused the FIR as well as statements. The FIR as well as statements in clear terms show that the present applicant along with the co-accused Gajanan attacked Gopal Thakare by means of axe and knife. The present applicant-Santosh infected stab blows of knife on chest and legs of Gopal. When Gopal's uncle Bhanudas Thakare tried to intervene, both the accused i.e. Santosh and Gajanan assaulted him by means of axe and knife. There are five stab wounds on the body of the deceased who died in hospital.

In view of above, there is evidence evidence showing prima facie involvement of the applicant. Hence, Criminal Application No.681/2015 is dismissed. JUDGE kahale
