The only prayer made by the petitioner in the writ petition is for a direction to the respondent no.1-Regional Commissioner, Social Welfare Department, Amravati Division, Amravati to decide the appeal filed by the petitioner bearing No.10/2015. It is stated on behalf of the petitioner that the petitioner is out of service since the year 2009 and though this appeal is filed on 16.5.2015, the matter was being prosecuted before the other forum for long.

Shri Patel, the learned Assistant Government Pleader appearing on behalf of the respondent no.1, states that if the appeal is pending with the respondent no.1, the same would be decided, as early as possible, in accordance with law.

Since the prayer made by the petitioner is innocuous, without issuing notice to the other respondents, we dispose of the petition, with a direction to the respondent no.1 to decide the appeal filed by the petitioner, after hearing the petitioner and the respondent nos.2 and 3, within a period of three months, from the date of appearance of the parties. It is stated that the parties are directed to appear before the respondent no.1 on 7.11.2015. Order accordingly. No costs.
