This is an application seeking condonation of delay of 103 days caused in filing the appeal challenging the order of conviction under Sections 376(2)(n), 376(3) and 376(AB) of the Indian Penal Code and Sections 4 and 6 of the Prevention of Children from Sexual Offences Act. The applicant is in jail.

For the reasons stated in the application, we are satisfied about the grounds for delay. Hence, the delay stands condoned.

CRIMINAL APPEAL NO. OF 2022 The appellant has been convicted for the offences punishable under Sections 376(2)(n), 376(3) and 376(AB) of the Indian Penal Code and Sections 4 and 6 of the Prevention of Children from Sexual Offences Act. The maximum sentence imposed is to undergo rigorous imprisonment for 20 years for the offence punishable under Section 376(3).

In view of Chapter 1, Rule 2 of the Bombay High Court Appellate Side Rules, the appeal may probably lie before the learned Single Judge. 7.
The Registrar (Judicial) to verify the position and place the matter before the appropriate Bench.
