The time placed by District Mining Officer on transport permit is being pressed into service to urge that as the permits are issued at 7.57 a.m. and 08.05 a.m. on 16/06/2016, contention of the respondent that tractor trolleys were found carrying sand illegally at 7.00 a.m. is falsified. We are not in a position to appreciate this contention at this stage.

Without observing anything on merits of the controversy and keeping all the rival contentions open, we dispose of the criminal application.
