The connected appeal, i.e., Second Appeal No. 346/2023 has been disposed of as amicably settled between the parties.

2] The learned Counsel for the appellants submits that the appellants are not giving instructions to him and, accordingly, he has issued notice under the Advocates Act, 1961 of his intention to return brief and to seek permission to withdraw his appearance. He submits that notice has been served upon the appellants. He seeks permission to place on record acknowledgment of the same.

3] Permission is granted. The learned Counsel stands discharged.

4] It appears that the appellants have lost interest in prosecuting the appeal, may be because the dispute has been settled amicably.

19-SA-406-2007 5] The appeal is, therefore, dismissed under Order XLI Rule 17 read with Order XLII Rule 1 of the Code of Civil Procedure, 1908.

6] Copy of order be served upon the appellants for taking necessary steps, if so desired.
