Heard Mrs. Smita Taksande, learned counsel (appointed) for the applicant and Shri Ahirkar, learned APP for the respondent.

The applicant, in jail, has approached this Court in an Appeal under Section 374(2) of the Code of Criminal Procedure through legal aid. He is undergoing life imprisonment and there is delay of 549 days in filing appeal.

The learned APP is seeking time to obtain instructions.

However, as we do not find any malafides, we condone the delay. Application is allowed. CRIMINAL APPEAL NO. OF 2015 Heard.

Shri Ahirkar, learned APP waives notice for the respondent.

Objections, if any, be removed within six weeks.
