Heard Mr. Mule, learned counsel for the applicant. Mr. Saoji, learned counsel for the nonapplicant is absent. 2.
Since petition under Section 9 of the Hindu Marriage Act as well as under the D.V. Act, instituted by the applicant are already pending before the Family Court at Bhandara, in which the non-applicant is already appearing, considering what has been held in D. Raja Rajeshwari Vs. R. Satish Kumar 2022 (2) SCC 329, Petition No.A-1159 of 2021 pending before the Principal Judge, Family Court, Nagpur is hereby transferred to the Family Court at Bhandara.

The parties through counsel shall appear before the learned Family Court, Bhandara on 3.10.2022 and place a copy of this order before the learned Court to apprise it of the same.

The parties through counsel shall appear before the learned Family Court, Nagpur and place a copy of this order before the learned Court to apprise it of the same, so as to enable it to transmit the record to the learned Family Court, Bhandara.

It is also made clear that the proceedings under D.V. Act as well as under Section 9 of the Hindu Marriage Act filed by the applicant and the proceedings which are hereby transferred shall be kept on the same date, so as to avoid any inconvenience to the nonapplicant/husband. 6.
The application is accordingly allowed in the above terms No costs.
