DATED : SEPTEMBER 13, 2019 At the outset, Mr. Doifode, learned A.P.P. for non applicant-State submits that during the pendency of present application, investigating officer has filed charge-sheet before the Court of law.

On such a submission being made, Mr. Siddiqui, learned counsel for applicant, submits that he wishes to withdraw the present application to enable him to file an application before the Court below, afresh.

The application is disposed of as withdrawn with liberty to the applicant to file an application afresh before the trial Court in view of change in circumstance i.e. filing of charge-sheet.

It is made clear that case of the applicant is not considered by this Court on its own merits.
