The present application is filed for bringing the legal heirs of deceased respondent no. 1 on record.

In view of the Pursis dated 16/11/2021 filed by the learned counsel for respondent no. 1, there is no delay in filing the present application. As such, the application is allowed. 3.

Permission is granted to bring the legal heirs of respondent no. 1 on record.

Necessary amendment to be carried out within a period of one week.

Shri A.R. Kalere, learned counsel waives notice for proposed legal heirs of respondent no. 1.

Accordingly, the application stands disposed of. CIVIL APPLICATION (CAS) NO. 393 OF 2020 The present application is filed for dispensing with filing of private paper book.

It appears that earlier in First Appeal No. 1055/2007, the appellant had filed private paper book before this Court. But, later on, due to enhance in pecuniary jurisdiction of District Court, the matter was transferred to learned District Judge, Nagpur. As such, the private paper book is already there on record. 3.

In view of the fact that, the R & P is received and private paper book is already on record, the application is allowed. 4.

The appellant is exempted from filing private paper book. 5.
