Heard Shri R.L.Khapre, learned advocate for the applicant. None for the Non-applicant No.3, though served. The learned advocate for the applicant states that this application was filed for clubbing of First Appeal No. 316 of 2009, pending before this Court and Regular Civil Appeal No.10 of 2009 pending before the District Court. It is submitted that because of enhancement of the jurisdiction, First Appeal No.316 of 2009 will be transferred to District Court, Nagpur.

In view of the above facts, the prayer made in the application does not survive. The application is disposed of as infructuous. In the circumstances, the parties to bear their own costs.

Needless to say that the applicant is at liberty to make appropriate application before the District Court in the matter.
