DATED : AUGUST 21, 2017 Heard learned counsel for applicant and learned A.P.P. for non-applicant for quite some time. The present application is for bail. The learned counsel for applicant submits that other co-accused are presently released on bail and present applicant is not. The learned A.P.P. makes a statement on the instructions from the investigating officer who is personally present in the Court that after co-accused were released on bail they repeated the same offence. Further against the present applicant, he is having criminal antecedents committing the offence under Section 394 r/w Section 34 of the Indian Penal Code. Looking to this, when the Court was about to dismiss the application, learned counsel for applicant submits that he wish to withdraw the present application. Permission is granted.
The application is dismissed as withdrawn.
