The applicant has filed this application to seek transfer of the proceedings filed by the non-applicant under the Hindu Marriage Act, 1955 vide Petition No. 78/2023 pending before the Civil Judge Senior Division, Malkapur to the Family Court, Akola.

The learned Counsel for the applicant has stated that the applicant is staying at Akola along with her two minor daughters. She has filed petition for maintenance before the Court at Akola and the nonapplicant is attending the said proceeding. She is getting meager maintenance, which is insufficient for her to pay the litigation charges at Malkapur. She cannot travel with her two minor daughters to Malkapur, which is 97 kilometers from Akola. As the non-applicant is attending the Court at Akola in maintenance proceeding, has requested to transfer the petition pending before the Civil Judge Senior Division, Malkapur to the Family Court, Akola.

Though the non-applicant is duly served, remained absent.

The applicant is staying with her two minor daughters. She is receiving maintenance which is insufficient for her to maintain herself and her two daughters and also to bear the traveling charges from Akola to Malkapur to attend each and every dates of the proceeding. Considering the inconvenience caused to the applicant, the application is allowed.

The Petition No. 78/2023 pending before the Civil Judge Senior Division, Malkapur is hereby transferred to the Family Court, Akola.
6.
There shall be no order as to costs.
