After hearing the learned Counsel for the applicant to some extent and after going through the investigation papers, as well as the earlier order passed by this Court which shows that the liberty is granted to the present applicant to approach the trial Court afresh once the victim and her mother are examined by the prosecution witnesses. Yet the victim and her mother is not examined, therefore at this stage, the applicant cannot avail the said liberty and liberty is granted to the applicant approached to the Sessions Court. Learned Counsel for the applicant seeks permission to withdraw the application.

The application is disposed of as withdrawn.

Learned Counsel is always at liberty to proceed with the trial and avail the benefit of the
