NAGPUR BENCH, NAGPUR CONTEMPT PETITION NO.241/2019 IN WRIT PETITION NO.7012/2017 Nilesh Jaykumar Chavan vs.

.............................................................................................................................................. Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders ............................................................................................................................................ Shri. A. P. Kalmegh, Advocate for the petitioner. CORAM : R.K. DESHPANDE & VINAY JOSHI, JJ.

DATED : 23th August, 2019 This Court had directed on 19-01-2018 in Writ Petition No.7012 of 2017 to the Scrutiny Committee to decide the caste claim by the petitioner within a period of 15 months. It is urged that the Scrutiny Committee has not yet decided the matter and the same is pending. The petitioner apprehends that if the Scrutiny Committee fails to decide the matter, the service of the petitioner may be terminated by the employer. We find that the apprehension is without any basis and the order passed by this Court is very clear, directing not to terminate the service of the petitioner, till the caste claim is decided. Obviously, if

CP No.241 of 2019 the termination is effected in violation of this direction, it is open for the petitioner to take appropriate step. The petition stand disposed of.
