DATE : 14/10/2022 Present application is filed for condonation of delay in filing restoration application. It is submitted by the learned Counsel for the applicants that the applicants are rustic villagers and poor agriculturist. There were office objections in second appeal which was directed to be removed within fourteen days. However, due to heavy rain, the Counsel for applicants could not reach this Court as he is from Amravati. He came to know about dismissal on 13/09/2022 when he circulated the matter.

Considering the reasons, I am satisfied that there is no deliberate delay. The delay of 22 days in filing restoration application, is hereby condoned.

CIVIL APPLICATION (MCA) STAMP NO. 15155/2022 The present application is for restoration of second appeal of which registration was refused for want of removal of office objection. The conditional order was passed by Registrar (Judicial) on 18/08/2022. In consequent to which the order was passed on 04/08/2022.

For the reasons stated in the application, the application is allowed. The orders passed by Registrar (Judicial) on 18/08/2022 and 04/08/2022 are hereby quashed and set aside.

The Registry is directed to register the second appeal within three days.

The application is disposed of.
