Heard Mr.S.R.Narnaware, learned Counsel for the applicant and Mr.Abhijit Deshpande, learned Counsel for respondent no.1. There is no appearance for other respondents, though they are served.

After hearing the learned Counsel for the applicants, on 14.1.2015, this Court issued common notice on the prayer for condonation of delay as also the prayer for restoration of Writ Petition.

Listing of matter on 7.3.2014 escaped attention of the Office of learned Counsel. As such, there is delay of 151 days in filing the application for restoration of Writ Petition.

As we do not see any mala fides, delay is condoned. Resultantly, Registry to register the Misc. Civil Application for restoration. Upon registration, the prayer

162cao1487.14 made in the Misc. Civil Application shall stand granted. Order dt.7.3.2014 is re-called. Writ Petition No.4268 of 2012 is restored back to file.

List Writ Petition No.4368 of 2012 for further consideration on 2.3.2015.
