The applicant, who is apprehending arrest in Crime 257/2018 registered with the Police Station Ralegaon, District Yavatmal for offence punishable under section 65(A) and 65(E) of the Maharashtra Prohibition Act, read with section 109 of the Indian Penal Code is before this Court since the learned Sessions Judge rejected the prayer for grant of interim anticipatory bail.
2] This application can be disposed of by requesting the learned Sessions Judge to decide the main application under section 438 of the Criminal Procedure Code within a week. It is not intended to suggest or imply that there is anything seriously wrong with the order impugned. However, since the learned counsel for the applicant submits that if the applicant is protected he shall appear before the Investigating Officer daily and shall co-operate in
aba566.18.O.odt 2 investigation, it would be appropriate to protect the applicant till the main application is decided by the learned Sessions Judge.
3] This application is disposed of with the following directions:
[i] The learned Sessions Judge is requested to decide the main application within seven days from the date of this order.
[ii] The applicant shall attend Police Station Ralegaon, District Yavatmal every day between 10:00 a.m. to 01:00 p.m. till the main application is disposed of by the learned Sessions Judge. [iii] The applicant shall co-operate with the Investigating Officer.
[iv] If the applicant does not co-operate with the Investigating Officer, the non-cooperation shall be duly considered by the learned Sessions Judge while deciding the main application.
[v] The applicant shall not tamper with the evidence nor shall the applicant directly or indirectly attempt to influence the witnesses in any manner.
