The learned Judge of the Small Causes Court, Nagpur is seeking extension of time to decide Regular Civil Suit No.161/2017.

The learned counsel for respondent no.1 - original plaintiff submits that vide order dated 22.08.2019 passed by this Court in Writ Petition No.5690/2019 what has been made time bound is application moved under Section 144 of the Code of Civil Procedure, 1908. The Court had directed that if such an application is moved it shall be decided within one month of its filing. The learned counsel for respondent no.1 submits that there are no directions to decide the suit in a time bound manner.

It appears that the learned Judge has not read the order passed by this Court, and therefore, the present letter.

In view of above, no order is called for extension of time because the suit is not made time bound. The learned Judge of Small Causes Court, Nagpur shall take note of the above.
