Heard learned counsel for the parties.

This application is filed for intervene in the present petition contending that the present applicant was a party to the suits which are mentioned in paragraph No.2 of the application. From the application, it is found that the applicant was a party to all the proceedings and is the wife of deceased Mohd.Aslam Aluwale s/o Haji Fazalur Rahim, who was a party to the proceedings. It is also noted that due to the death of husband, the applicant was brought on record in the proceedings. We thus found that she is necessary party to the present petition.

The application is therefore disposed of as

14APPW 211.19 allowed. Learned counsel for the petitioners is directed to amend the petition by adding the applicant Shaheda Begam w/o Mohd.Aslam as party respondent No.5.

Shri Ashish Chaware, learned counsel waives notice for newly added respondent No.5. S.O. to 05/02/2020 for affidavit-in-reply.
