Heard learned Counsel for the applicant to some extent and perused the investigation papers from which it reveals that 13 years girl was subjected for sexual assault. Considering the gravity of the offence, I have shown my disinclination to grant bail. Hence, learned Counsel for the applicant seeks permission to withdraw the application. However, learned trial Court has to consider that the applicant is behind bar from last two years and shall expedite the trial and dispose of within one year, if there is no substantial progress in the trial, the applicant is at liberty to move after one year.
