DATED : OCTOBER 31, 2018 This is an application under Section 24 of the Code of Civil Procedure for transfer of Hindu Marriage Petition No.A-219/2017 from Family Court, Aurangabad to Family Court, Nagpur.

On 24.08.2017, this Court (Coram: S.B.

Shukre, J.) issued notices to non applicants and granted ad interim stay in favour of the applicant. Office note shows that non applicant could not be served for want of time. When this application is taken up for consideration, learned counsel for the applicant submits that parties to this application have mutually obtained decree of divorce and therefore present application has rendered infructuous and he has instructions to withdraw the present application.

In that view of the matter, the application is disposed of as infructuous.
