The present application is filed for grant of permission to delete the name of appellant no. 2.

It is submitted that appellant no. 2 was unmarried and he died on 01/09/2019 during the pendency of present appal. There is no legal heirs of appellant no. 2 except appellant no. 1. As the application is supported by affidavit, the application is allowed. 3.

Permission is granted to delete the name of appellant no. 2. 4.

Necessary amendment to be carried out forthwith. 5.

Accordingly, the application stands disposed of. P URSIS (ST.) NO. 02/2023 Learned counsel for the appellants has filed Pursis stating that appellant no. 1 does not want to proceed the present appeal and he seeks to withdraw the appeal.
