Heard learned counsel Shri R.J. Shinde for the petitioner and learned Additional Public Prosecutor Shri M.J. Khan for respondent Nos.1 to 3/State. The rate of interest, as demanded by the creditor, is as stipulated in the written agreement between the parties. In the absence of any allegations raising appropriate challenge to that agreement, grievance that no cognizance of F.I.R. alleging offences under Section 498A of the Indian Penal Code is being taken, cannot be sustained.

With liberty to the petitioner to take such other steps as are open to him in law, we dispose of the writ petition. No costs.
