On confronting with the situation that the remedy was open to the petitioner subsequent to passing of the award, which even pronounced upon the levy of parking charges and penalty on dead inventory/buffer stock, which are included in the running bills of the petitioner, now the only option open to the petitioner is to file the proceedings under Section 9 of the Arbitration and Conciliation Act, 1996, since filing of the proceedings under Section 9 of the said Act is permissible on culmination of the arbitration proceedings when the award is declared. 2.

The learned Senior Advocate appearing for the petitioner seeks to withdraw the petition with liberty to file the proceedings under Section 9 of the said Act. However, he prays that the interim order granted on 20th August, 2024 be continued for a period of two weeks. 3.

We see no difficulty in granting the said request, as we permit the withdrawal of the petition with liberty as prayed for.

The interim order dated 20th August, 2024 shall continue to operate for a period of two weeks from today and after expiry of the said period, the said interim order shall cease to operate. 5.
