OCTOBER 25, 2016 Heard the learned counsel for the applicant and the learned A.P.P. for non applicant no.1/State. Perused the Case Dairy.

It is seen from the allegations made against this applicant as well as with the material available on record that prima facie the applicant is involved in the offence alleged therein. The applicant does not possess any license to transport or to possess liquor and yet, from the Car owned by him liquor bottles of the value of Rs.51,300/- and also the sword have been recovered and seized.

Similar offences have been registered against the applicant in the past. From the Crime chart produced before me, one can see that this

applicant has been repeatedly indulged in criminal behaviour and for its major part, it relates to illegally dealing in liquor. There appears to be a pattern of criminal behaviour starting from the year 2001. The learned counsel for the applicant submits that in most of these cases, the applicant has been acquitted by the Courts. However, he submits that, he does not have any instructions regarding specific number of acquittals secured by the applicant. Even if this statement is accepted as it is, the fact remains that some cases still have remained pending against the applicant. With such a criminal behaviour and also the material available on record showing, prima facie, involvement, I am not inclined to grant bail to this applicant.

The application stands rejected.
