From the perusal of afÏdavit-in-reply, it could be seen that the offence was committed by the petitioner in premeditate manner.

In that view of the matter, the petitioner has been rightly categorized in the category 1(D) of the guidelines dated 15/03/2010 and, therefore, no case is made out of interference in the writ jurisdiction. Hence, the petition stands rejected. Fees payable to the learned Counsel appointed for the petitioner are quantified at Rs.1,500/- (Rupees One Thousand Five Hundred Only). JUDGE JUDGE *sdw
