By this writ petition, the petitioners seek a declaration that the action on the part of the respondents in not granting promotional pay-scale of Junior Engineer to the petitioners with effect from the date they had completed twelve years of service is unjust, improper and illegal. The petitioners seek a direction to the respondents to grant the promotional pay-scale of Junior Engineer to the petitioners with effect from the date on which they completed twelve years of service.
Shri Meghe, the learned counsel for the petitioners, states that the issue involved in this case was also involved in a bunch of writ petitions bearing Writ Petition No.3815 of 2012 & Others and this Court has, by a common judgment dated
WP5185,5732&5838-14 29.08.2013, allowed the writ petitions and directed the respondents to grant the benefits to the petitioners therein in accordance with the circular dated 18.06.1998. It is stated that the case of the petitioners stands squarely covered by the judgment dated 29.08.2013.
Shri Kakani, the learned counsel for the respondent nos.1 to 3 and Shri Patil, the learned Assistant Government Pleader for the respondent no.4, does not dispute the statement made on behalf of the petitioners. It is stated that the issue stands answered by the judgment dated 29.08.2013 in favour of the petitioners. Hence, for the reasons recorded in the judgment dated 29.08.2013 in the bunch of petitions bearing Writ Petition No.3815 of 2012 & Others, the writ petition is allowed. It is hereby declared that the petitioners are entitled to the benefit of the pay-scale of a Junior Engineer on completion of twelve years of service from the date of their entry in the cadre of Technical Assistant/Mistry/ Karkoon, etc. The respondents should grant the benefits to the petitioners at the earliest.
Order accordingly. No costs.
