The learned Advocate for the non-applicants seeks time to file reply. The request is rejected. The applicant is a person aged around 69 years. It is stated in the application that the applicant had undergone ophthalmic operation in the month of April and May, 2025 and was advised to take rest. It is further stated that the applicant is a patient of Hypertension and Chronic Obstructive Pulmonary disease. Medical certificates in support of the contention pertaining to medical condition are filed on record. The delay in filing the second appeal is of 56 days. The non-applicants have also preferred a substantive appeal challenging the same decree.

In view of aforesaid, I am inclined to allow the application for condonation of delay. Hence, the application is allowed and the delay of 56 days in filing the second

6.cas.906.2025.odt appeal is condoned, however subject to payment of costs of Rs.2,000/- to be paid by the applicant to the non-applicants within a period of two weeks.
