DATE : September 16, 2019 Heard Shri H. R. Gadhia, learned counsel for the petitioner, Shri A. V. Palshikar, learned Assistant Government Pleader for respondent No.1 and Shri M. B. Agasti, learned counsel for respondent No.2. After hearing learned counsel for the parties and after perusing the documents placed on record it is found that the observations made in paragraph 11 of the impugned order dated 03/08/2019 are sufficient to take care of the apprehension expressed by the petitioner. In that view of the matter and as it is found that the impugned order is procedural in nature, there is no case made out to interfere in writ jurisdiction. It is clarified that observations made in paragraph 11 shall be kept in mind by the authorised Officer while finally adjudicating the matter. Writ petition is accordingly dismissed. No costs. In view of dismissal of the writ petition it is not necessary to entertain the Civil Applications which are filed. Same are accordingly dismissed.
