At the outset, Learned APP states that the trial has commenced, in as much as, the trial Court has commenced with the recording of evidence and that the next date in the trial court is 13th November, 2017.

Considering the fact, that the trial has already commenced, and this Court has already expedited the trial, it would not be appropriate to interfere in the impugned order, at this stage. Accordingly, the petition is disposed of. All the contentions raised in this petition are kept open. Since the trial has already commenced, it is expected that the Learned Judge shall conclude the same as expeditious as possible, in terms of the earlier order passed by this Court.

Accordingly, the petition is disposed of.
